Its been in the news lately that A Day To Remember has a lawsuit going on against Victory Records. People were unsure of when it was, if it was a new one or an ongoing one from May. Turns out, it is an on going on from May, and Alternative Press has gotten some more updates and details. All of this actually came about on December 15, but I was slow on finding out -sorry! "10:44 AM ET: A Day To Remember's management declined comment on the grounds that it's an ongoing suit. We're still awaiting word from Victory Records. Keep checking this post for updated information. UPDATE 12:13 PM ET: Victory Records has released a statement regarding the lawsuit. Check it out below, and the updated legal documents including Victory's countersuit can also be seen below. Statement on behalf of Victory Records, Inc. Dated: December 15, 2011 Recent reports of claims filed by the Victory artist A Day to Remember (ADTR) in litigation presently pending in US District Court in the Northern District of Illinois (a case that was just transferred from Nashville upon Victory’s successful motion based upon improper venue) have misleadingly stated that the principal issue in the case concerns the payment of royalties. The lawsuit, filed shortly after the band hired new management, is really about the band’s refusal to fulfill their 5-album contractual commitment to Victory and their newfound desire to move to a major label. Recycled and often apocryphal stories of misguided and unsuccessful attempts by a few Victory bands to jump ship from the label that put them on the map have one common truthful thread; they always end badly for the band. In those cases, the bands eventually seek reconciliation and often ask to return to the Victory fold after having been disappointed by their post-Victory experiences. Victory is confident that this dispute will be resolved to the satisfaction of both the band and Victory, and that ADTR will continue to deliver great music to Victory in the coming years. Victory continues to honor its commitment to ADTR by placing its significant resources behind the band’s current album, What Separates Me From You, which continues to climb the charts and meet or exceed Victory’s expectations. The band, in the meantime, has enjoyed the benefits of the hundreds of thousands of dollars in record royalties generated from their album sales, which Victory accounts for in full compliance with its contract. Victory's job remains the same- work hard, sell records and abide by our agreements. 3:25 PM ET: A Day To Remember has given Altpress.com an exclusive statement regarding this matter. Read it below. "A Day To Remember would like to make it clear that they did not announce nor seek any attention regarding their ongoing suit with Victory Records. This information has been public record since May of 2011 and they have no intention of speaking publicly or disparagingly regarding their disagreement with Victory. A Day To Remember will continue to release music for their fans and are looking forward to touring in 2012." Some other big news has come up this week. Hey Monday has announced a break. Singer, Cassedee Pope will be going on her own solo acoustic tour in early 2012, and she decided to clear things up a bit on her official page. "Hey everyone! Cassadee here. I know since I announced my solo acoustic tour, there has been a lot of rumors and confusion swirling around. I wanted to let you all know that Hey Monday is not "broken up." We are, however, taking a break and pursuing things on our own. In my case, that is a solo project. I hope you all understand that this does not mean we'll never rel...ease new music or tour ever again. I just felt the need to fill you all in since I've gotten a good amount of questions pertaining to this. Me and the guys are still friends and always will be, and this was a decision we all agreed was for the best. I could not have imagined experiencing everything we were able to with a different group of people, our crew included! So we would really appreciate all of your support with this decision. We love you guys and we thank you for everything you've done for this band and each one of us individually. We have the best fans ever. Ps. I WILL be playing some HM songs during my tour!! And also some new material I have been working on. ♥" In other news, Say Anything have released a lyric video for their song, "Burn A Miracle", which will be on their upcoming album, Anarchy, My Dear. That can be expected around March 2012. On January 24, Lamb Of God will be releasing their seventh alum, Resolution, and they have posted a teaser for it. We Came As Romans has announced a headlining tour starting March 9, with support from Emmure, Blesthefall, the Color Morale and Woe Is Me. The Maine decided to release a live verison of an older song, "We All Roll Along." The song was originally featured on their debut album, Can't Stop, Won't Stop, and you can hear the live verison on their website, which is linked below. Boys Like Girls have been working on their third studio album for some time now, and they are now updating fans for a second time. The All American Rejects will be releasing a new album, Kids In The Street in 2012, and they have now played an acoustic verison of one of the new songs. This one is called "I For You". The album title was just announced yesterday (12/19). I actually heard about this days ago, but I myself didn't listen to it, as ever since they kicked Max out of Escape The Fate, I have been semi-annoyed with Craig, but Craig Mabbitt of Escape The Fate posted a song called "Making Christmas". The song is from the movie The Nightmare Before Christmas, and you can hear the song on Noisecreep, there's a link at the bottom of this article. Green Day frontman, Billie Joel, is rumored to be started a family project called "The Boo." His wife, Adrienne revealed the name on Twitter by saying, "The family band ❤ pic.twitter.com/7B33n4ZA." More details will hopefully come. Artist Vs Poet recently released a free Christmas EP, Naughty or Nice. On it was one original track and several covers, and now they have released a lyric video for "Airplanes and Candy Canes." I See Stars has announced their third studio album will be dropping on March 13, 2012 via Twitter by saying, "2012 is our year and by our we mean us and you amazing fans! Everyone help spread the word about the album drop!! MARCH 13 2012 #ISSTAKEOVER." Rumors that Jon Bon Jovi of the ever famous band, Bon Jovi, had died! However, none of this was true, and the band reassured fans by posting a picture on their Facebook pageof him in front of a Christmas tree with the caption, "'Heaven looks a lot like New Jersey' -jbj. Rest assured that Jon is alive and well! This photo was just taken." LINKS!

Simple Plan has posted a holiday update video. We Came As Romans will be releasing a video for their song "Just Keep Breathing" tonight at 6pm EST on their Facebook page. Four Year Strong also has a video out today. Their video is them discussing their latest album, In Some Way, Shape Or Form. Its been circling all over the internet that the ever popular, A Day To Remember may be filing a lawsuit against their label, Victory Records. While it has yet to be confirmed that this is true, a document has been uncovered from May 31, 2011, that was filed by the members of ADTR in District Court in Tennessee. The document started that ADTR wanted "an accounting of the Defendants to disclose fully and accurately monies earned and amounts due." From what I'm gathering from this, that simply means ADTR was not recieveing the money they earned, and wanted it, rightfully so. Whether this is tied in with some new lawsuit, or if that one had ever been resolved is unknown. People are trying to reach out to the record and the band for more commentary now. In less legal news, D.R.U.G.S has announced the pre-sale for their first headlining tour. The S.I.N. tour will begin on January 19, 2011, and in support for them will be Hit The Lights, Like Moths To Flames, and Sparks The Rescue. Pre-sale tickets are on sale now through their website, and for certain dates that entails access to the sound check, a meet and greet, a commemorative VIP laminate and a limited edition signed poster. My Ticket Home has announced they'll be releasing a new single, "A New Breed" on December 20, along with a teaser for the song. The band will also be releasing their debut album, To Create A Cure on January 31, 2012. Check out the clip here. I almost forgot! Yesterday, five more bands were confirmed for the Vans Warped tour 2012! Every Time I Die, Vampires Everywhere!, Tomorrow's Bad Seeds, and Polar Bear Club. Vampires Everywhere! has confirmed that they will be playing every single date of the Warped tour next year. The French Band, Chunk! No Captian Chunk, has just released a music video for their song, "Captian Blood". The video is unlisted on YouTube, so if you know someone who would like to see it, you'll have to send them the link. Otherwise, they will not be able to find it. While playing at a House Of Blues in Cleveland, Ohio, Patrick Stump got into the Christmas spirit by covering the holiday classic, "This Christmas". Footage of that can be viewed right here. As I Lay Dying and The Maine both had the same idea and released some tour updates and behind the scenes footage. As I Lay Dying has a behind the scenes video of their latest music video, "Electric Eye", and a tour update for the second week of their Decade Of Destruction tour. Watch both of those below. As for The Maine, it is more in studio footage, featuring behind the scenes of the making of their latest album Pioneer. NeverShoutNever is offering fans a free download of his song, "Smelyalata". With the thoughts of EP on the brain, it is very much so worth mentioning that today Black Veil Brides released their iTunes exclusive EP, Rebels. The EP features an original song that didn't make it onto their sophmore album, Set The World On Fire, called "Coffin", and two covers. "Unholy" (Originally done by KISS), and "Rebel Yell" (Originally done by Billy Idol). If you pre-ordered the EP, you also got a six minute video of "Rebel Love Song." Miss May I is planning to go out on a European tour with Parkway Drive, the Ghost Inside and Confession this April. They said this while performing along side Mayday Parade, We Are The In Crowd, The Make, and There For Tomorrow on The Noise tour. More will be coming from now all through April, so keep checking back, as I'll keep you updated the best I know how. There's still rumors of Falling In Reverse playing the mainstage, as well as All Time Low, and Yellowcard. I am just waiting for that to be confirmed. I have also heard some talk of the possibilty of D.R.U.G.S coming back, and Black Veil Brides. Whether its true, who knows? We'll have to wait and see! Christopher Drew is at it again with his side projects. Today he has released a new track from his newest side project, Gonzo. The song is called, "Earthling" and can be heard below.
